What it is

Arizona unemployment insurance provides weekly pay after a qualifying work loss.

Unemployment is money for people who lost work through no fault of their own. If you are laid off or your employer cuts your hours, you can usually claim. If you quit to care for your child, Arizona decides case by case, and it looks at whether you asked for leave first. Each week you claim you also have to be able to take a job, which is hard during intensive treatment.

Eligibility rules
  • DES decides each claim on its facts. Choosing to work fewer hours yourself does not open a claim.
  • Quitting to care for a sick child can count as a compelling reason if you asked for leave first and no reasonable alternative existed. Keep the request and the reply. You must still be able to take work each week you claim.
What you get
  • Up to $320 a week for an allowed claim.
  • Possible partial benefits after an eligible reduction in work.
What the help includes
  • If your employer cuts your hours, you can get part of the weekly amount. The first $160 you earn in a week is ignored; earnings above that come off the payment. Your pay for the week has to be less than the weekly amount. Choosing fewer hours yourself does not count.
  • The $320 statutory maximum and $160 earnings disregard apply from July 1, 2022. DES describes a current $236–$320 weekly range, but the actual wage record and benefit calculation decide the award.
  • For example, an otherwise eligible $320-benefit week with $200 gross earnings pays $280: $320 minus the $40 above the disregard. Earnings at or above the weekly benefit amount fail the separate earnings test.
  • Payments last up to 24 weeks, or 26 when the state unemployment rate is 5% or more. The total is also capped at a third of what you earned in the base period. DES confirms which applies.

  1. Ask HR to explain leave, reduced-hours or furlough options in writing before deciding about resignation.
  2. If you decide to claim, describe the work change to DES and have 18 months of pay records, the separation notice and employer replies ready.

After you ask
  • The decision gives the weekly amount or reason for denial. An appeal has the deadline printed on the decision.
  • The first payment usually takes about 15 business days, and the first week is unpaid. An appeal must be filed within 15 days of the mailed decision.
Good to know

This mainly helps a parent whose employer ends or cuts the job. Weeks spent full time at the bedside usually do not pay.

  • A written leave request and your employer's answer show DES that you tried to keep the job. They help, but they do not guarantee a claim.

How long: DES confirms the claim’s status; processing estimates are not guarantees. Initial benefit appeals generally have 15 days after mailing, while review of an administrative-law-judge decision generally has 30 days. The notice gives the applicable deadline.

Watch out

  • You must still be able to work and available for work each week you claim.
  • Cutting your own hours does not on its own open a claim.
  • A caregiving resignation can fit the compelling-personal-reason exception only under its conditions. DES checks unavailable or impracticable leave, reasonable alternatives and efforts to preserve employment.

What it is worth

Weekly benefits can be up to $320 for an allowed claim. Duration is up to 24 or 26 weeks under the unemployment-rate rule.

  • $320/week — Most the state pays a week
  • $236/week — Least the state pays a week
  • $24 — Up to 24 weeks under the lower-rate branch; up to 26 under the higher-rate branch
  • $160/week — Weekly earnings ignored before partial pay is reduced

Legal protection: Partial unemployment requires a qualifying no-fault reduction and gross weekly earnings below the weekly benefit amount before the $160 disregard; for an otherwise eligible week, earnings above $160 reduce payment dollar for dollar.
