Pay while caring for your child (Paid Family Leave)

What it is
State pay to replace some lost wages while you care for a seriously ill child, if you qualify.
Paid Family Leave can replace income when you take care leave, including separate days. Each eligible parent has their own limit. It does not itself protect your job, so leave rights and employer policy need a separate check.
Who can get it
- Paid Family Leave replaces wages but does not itself protect your job. EDD checks your State Disability Insurance wages, the base period, lost wages and need for family care. You generally must be employed or actively seeking work when leave begins. Saying you are “not working” now does not settle that question.
- Self-employed parents need elective EDD coverage. The highest-earning quarter, rather than the current paycheck, determines the payment.
- In 2026 lower earners get 90% of their pay and higher earners 70%, up to $1,765 a week. EDD works the amount out from your best-paid quarter, not your current paycheck.
- EDD generally requires at least $300 of SDI-covered wages in the base period. For 2026, weekly benefits range from $50 to $1,765 and last up to eight weeks in a 12-month period, with no PFL waiting period.

If you decide to apply
- Ask the clinic who can sign the medical certification, then use myEDD or form DE 2501F if you decide to claim Paid Family Leave.
- Have ready: recent pay stubs, your first day of leave, the employer’s name and address, the clinic contact signing the certification and form DE 2501F if using paper.

What happens next
- EDD reviews the completed claim and medical certification, then sends the weekly amount and payable dates.
- The eight-week limit covers all Paid Family Leave reasons in the same 12-month period. Each eligible parent has their own limit.
Good to know
EDD’s ordinary filing window is day 1 through day 41 after family leave begins. Late filing can reduce benefits.
What else to know
- PFL itself does not protect the job. CFRA and FMLA can cover the same absence when their requirements are met. Payroll can explain how employer pay is designated.
- Part-time wages during a claim week may reduce that week’s payment. Intermittent claims need the days worked identified.
- Since January 1, 2025, an employer cannot require vacation use before PFL. PFL is federally taxable but exempt from California income tax.
- The 2026 SDI contribution is 1.3% of covered wages. Your own illness uses Disability Insurance rules instead, including a seven-day waiting period.
- EDD does not pay PFL and unemployment for the same period. Each parent’s covered earnings, work status and care leave require separate review. A pregnant household member’s pregnancy-related leave or disability benefit also has separate tests.

Who does what
The three parts, side by side. The agency decides; nobody on this page does.

File the claim at myEDD within 41 days of the first day off and give the doctor's office the medical part to sign.
Your social worker
The social worker knows who at the clinic signs EDD certifications and how fast. Ask them to walk it through.
The care team
The oncologist (or a nurse practitioner) signs the medical certification that the child is seriously ill and needs your care.

Watch out
- File within 41 days of the first day off or you lose weeks.
- PFL is pay, not job protection. Ask HR for the state and federal family-leave paperwork the same week.
- You can take the 8 weeks a day at a time. Attach a note to the claim listing the days worked.
- Each parent has their own 8 weeks. The 8 weeks cover every PFL reason (care, bonding) in 12 months.
- Since 2025 an employer cannot make you burn vacation before PFL. Part-time wages during a claim week can lower that week's payment.
- PFL is taxed on your federal return only. California does not tax it.
- Self-employed parents have PFL only if they bought elective coverage. A parent who is themselves sick, or pregnant, files Disability Insurance instead (7-day wait).
