What it is

Unemployment pay after a qualifying job loss or cut in hours, while you remain able and available for suitable work.

Unemployment is money for people who lost work and can take a new job. If you are laid off, you can usually claim. If you quit to care for your seriously ill child, California can accept that as a good reason, as long as you tried leave or a schedule change first. Each week you claim you still have to be able to take a job, and full-time bedside care usually rules a week out.

Who can get it
  • EDD decides whether the separation had good cause and whether the parent is able and available for work each week.
  • Leaving to care for a seriously ill child can be good cause when the care is reasonably necessary and reasonable alternatives are unavailable. EDD checks efforts to keep the job, such as leave, a schedule change or other care when feasible. You still must be able and available for suitable work each week you claim.
  • If your employer cuts your hours, you can get part of the weekly amount. EDD ignores the first $25 you earn when you earn $100 or less; above $100 it ignores 25%. The rest comes off the payment. EDD also asks why the hours fell. Employer Work Sharing plans use different rules.

If you decide to apply
  1. Ask EDD about the reason work ended or hours changed, your leave requests and whether you can accept work. Use UI Online if you decide to claim.
  2. Have ready: your written leave request and employer’s answer, pay stubs for the last 18 months and a care-team letter explaining the care needed.

What happens next
  • After a quit, EDD usually phones you for an interview about why you left. Each week you then confirm you could have worked.
  • The notice gives the benefit amount or disqualification reason and the appeal deadline.
Good to know

A good reason for leaving is only half of it. EDD also asks whether leave was on offer, and it pays only for weeks you could work. Paid Family Leave usually fits bedside care better.

What else to know
  • This program is not a substitute for paid care leave when a parent cannot accept work. The social worker and payroll office can compare PFL and leave options.
  • These are the ordinary partial-earnings rules. Employer-approved Work Sharing generally uses a 10%–60% cut in hours and wages with a separate calculation.

Watch out

  • Before resigning, ask for leave, a schedule change or Paid Family Leave. EDD checks whether those options existed.
  • A parent at the bedside full-time usually cannot take other work. Report your availability honestly.
  • A good reason for quitting does not guarantee unemployment. EDD separately checks whether you can take work each week.
  • Partial unemployment is for hours cut by the employer for lack of work. Hours you gave up to be at the hospital do not count.

The trap: Reporting availability you do not have. One old precedent accepted daytime availability where daytime child care existed. It is not a promise for every part-time restriction.
