Unemployment after a job ends (Reemployment Assistance)

Reemployment Assistance replaces some wages after a qualifying job loss when you remain available for work.

What it is

Reemployment Assistance replaces some wages after a qualifying job loss when you remain available for work.

Unemployment is money for people who lost their job through no fault of their own. If your employer lets you go or cuts your hours, you can claim. If you quit to care for your child, Florida does not pay, because it does not count a child's illness as a good reason to leave. Each week you claim you also have to be able to take a job, which is hard during intensive treatment.

Eligibility rules
  • Florida accepts a quit only when the employer did something wrong or the worker is ill or disabled. Quitting to care for a sick child is not on that list.
  • You must be able to work and available for work each claimed week. FloridaCommerce decides the separation and each weekly claim.
What you get
  • From $32 to $275 a week when FloridaCommerce finds the claim eligible.
What the help covers
  • If your employer cuts your hours, you can get part of the weekly amount. In 2026, earnings above $58 come off the payment dollar for dollar. A $275 payment with $200 earned leaves $133. Your pay for the week has to be less than the weekly amount.
If you decide to apply
  1. Ask the social worker and your employer’s benefits office to compare leave options before a decision about resignation.
  2. If you decide to request benefits, use FloridaCommerce’s claim system with your work history and separation records.

What happens next
  • How many weeks you can get is set each year from the state unemployment rate. FloridaCommerce tells you the number for your claim.
Good to know

This mainly helps a parent whose employer ends or cuts the job. Weeks on a leave of absence you asked for do not pay either, because you still have a job.

Other details
  • A written leave request and the employer’s response help explain what happened. They do not guarantee an unemployment award.
Ask your social worker

“If my work changes because of my child's treatment, would unemployment pay me, or does quitting rule it out? Does this fit us, and can you help me look at leave first?”

Why I’m asking: I do not want to rely on unemployment benefits that caregiving or a resignation could rule out.

Who does what

The three parts, side by side. The agency decides; nobody on this page does.

You

Ask for leave or a furlough in writing before resigning, keep the answer, and file the week work ends if the employer ends the job.

Your social worker

The social worker helps get the doctor's letter and compares leave options with you before you resign.

The care team

Documents the child's condition and the care schedule for the leave request.

Who decides
FloridaCommerce, the state unemployment office, decides the separation and each week's claim.
Ask HR
“Before I resign, what leave can you give me in writing: federal leave (FMLA), unpaid leave or a furlough? If the job has to end, can it be the company's decision rather than my resignation?”

How to apply

First step: Before resigning, ask the employer's benefits office in writing for federal family leave (FMLA), unpaid leave, a furlough or a separation on the employer's side. Keep the answer. If the job ends on the employer's side, file with FloridaCommerce (the state unemployment office) the week work ends.

  1. Before resigning, ask the employer in writing for federal leave (FMLA), unpaid leave, a furlough or an employer-initiated separation.
  2. If the employer ends the job, file with FloridaCommerce the week work ends.

Where it starts: File online through FloridaCommerce's Reemployment Assistance system the week work ends

What to gather

  • Your written leave request and the employer's answer
  • The separation notice
  • Recent pay records (the weekly benefit is one twenty-sixth of your highest quarter's wages)

How long: File the week work ends. The first payment comes after FloridaCommerce decides the claim, and you claim each week after that.

What a yes looks like

A decision that the separation was not disqualifying, and weekly payments while you confirm you are able and available for work.

What a no looks like, and the next move

'Voluntarily left without good cause attributable to the employer': appeal by the date on the letter, and check SNAP (food help) and Medicaid for the parent, which use this month's income.

Watch out

  • A child's illness is not 'good cause' in Florida's law; only the employer's conduct or your own illness or disability is. Quitting to care for your child is treated as a personal quit.
  • A leave of absence you start yourself also loses those weeks. Ask the employer to put any leave in writing as its decision or under federal family leave (FMLA).
  • FloridaCommerce confirms the current claim-year maximum weeks under Florida’s annual unemployment-rate formula.

If they say no, quote this: Voluntary-quit rule: Fla. Stat. §443.101.

Dates that change this

2026-01-01: The supplied review could not corroborate the earlier 12-week/$3,300 FAQ excerpt. FloridaCommerce must confirm the current claim-year maximum under the annual statutory formula. (not yet confirmed against the final rule)

The numbers and the rules

The arcane layer, kept on purpose. Checked September 9, 2026.

What it is worth

$32 to $275 weekly when separation, earnings, ability and availability rules are met. FloridaCommerce confirms the claim-year duration. Quitting solely for a child’s illness is not the worker’s-own-illness exception.

  • $275/week (statutory ceiling (§443.111(3))) — Maximum weekly benefit
  • $32/week — Minimum weekly benefit

Legal protection: Partial benefits require less than full-time work and earnings below the weekly benefit amount; earnings above $58 reduce an otherwise payable weekly benefit in 2026.

What it costs the family: None.

The eligibility facts, as published

Separation
"good cause" includes only cause attributable to the employer, or the individual's own illness or disability (§443.101(1)(a)1); a quit for a child's illness is outside the definition
Voluntary leave of absence
a week of unemployment due to a leave the worker initiated is disqualified (§443.101(1)(c))
Able and available
the claimant must be able to work and available for work each week (§443.091(1)(d))

Partial benefits
Less than full-time work and weekly earnings below the claimant’s own weekly benefit amount are required first. For an otherwise eligible week in 2026, earnings above $58 reduce the benefit dollar for dollar.
Agency precedent
Appeals Commission Order 14-05679: a quit for a family member's illness without first requesting and being denied leave or accommodation (PRACTICE, indexed excerpt)

Decisions this site cannot make: Separation determination · Weekly claim

Expect friction on: The reason for leaving is decided from the employer's and your statements · Hours cut for caregiving must still leave you able and available

The trap: Resigning first and asking questions later. The appeals board has treated quitting for a family member's illness without first asking for leave, and being refused, as important. Before you resign, ask in writing for federal family leave (FMLA), unpaid leave, a furlough or a separation on the employer's side.
