Unemployment is money for people who lost work and can take a new job. If you are laid off, you can usually claim. If you quit to care for your seriously ill child, Illinois can still pay, as long as your employer could not give you the leave or schedule you needed. Each week you claim you still have to be able to take a job, which is hard during intensive treatment.

Eligibility rules
  • The rule covers a quit to care for a child whose illness or disability is confirmed, when your employer could not give you the leave or schedule you needed.
  • A leave or schedule-change request and the employer’s response help document the need to leave. The statute accepts a physician’s verification or other reasonable verification of the child’s condition; it does not require one exclusive letter.
  • You must meet the ordinary earnings and weekly eligibility rules.
What you get
  • From $51 to $628 weekly in 2026 benefit years, depending on prior wages.
  • Up to $859 weekly with a qualifying dependent child, for up to 26 weeks.
What the help includes
  • The 2026 maximum with a qualifying nonworking spouse is $748 weekly. Dependent allowances have their own requirements.
  • If your employer cuts your hours, your pay for the week has to be less than your basic weekly amount. Earnings above half that amount come off the payment dollar for dollar.

Even when Illinois accepts why you left, it pays only for weeks you could take a job. Full-time bedside care usually rules a week out.

Watch out

  • The exception needs a written accommodation request the employer could not grant, plus a doctor's verification. Nothing on paper, nothing to claim.
  • You must stay able and available for work each week; a parent who cannot work at all does not get paid.
  • Unemployment is unearned income for your child's SSI: the SSI cutoff roughly halves while it is paid.

If they say no, quote this: 820 ILCS 405/601(B)(1)(c): leaving to care for a child verified to be in poor health or disabled is not disqualifying where "the employer is unable to accommodate the individual's need to provide such assistance".

Expect friction on: Availability while caregiving is judged week by week

The trap: The exception needs two things most families skip: a written request for accommodation (leave, schedule change, remote work) that the employer could not grant, and a doctor's verification of the child's condition. Resigning with nothing on paper loses it.
