Kentucky has no state paid family leave program. The employer’s benefits office can explain which absences are paid and which protect your job. Federal family leave can provide unpaid job protection when its tests are met. Kentucky classified state employees have specific family-care sick-leave rights.

Eligibility rules
  • Employed; the federal tests are 12 months, 1,250 hours and 50 employees within 75 miles.
  • FMLA uses employer, worksite and employment-history rules. Living in Kentucky is not a federal eligibility requirement.
  • Classified state employees generally earn one working day of sick leave for a qualifying month and may use it for eligible immediate-family care. Kentucky school employees have a separate sick-leave law. Municipal, other public and unclassified employees need their own employer’s written rules; a public job title alone does not establish these benefits.

  • Kentucky has no statewide paid family leave benefit for private employees. FMLA may protect unpaid leave; employer-paid time, optional paid family leave insurance and public-employer leave rules are separate.
  • Federal FMLA usually requires 12 months of employment, 1,250 hours in the prior year and 50 employees within 75 miles. Public agencies and schools are covered employers regardless of size, but employee eligibility still needs checking.
  • Classified state employees generally earn one working day of sick leave after 100 qualifying worked or paid hours in a month. Covered full-time school employees have a separate minimum of ten sick days per school year. The employer confirms classification, balances, certification and family-care use.

Watch out

  • Kentucky lets employers buy paid family leave insurance but does not require it. Ask whether yours did.
  • Nobody proved Kentucky has no such law. If an employer says the state requires nothing, ask for that in writing.
