Maine leave law can protect your job while you care for your child.

What it is

Maine leave law can protect your job while you care for your child.

Maine’s family medical leave law reaches some jobs that federal FMLA does not. Employer size and your work history still matter. The leave can be unpaid, with paid leave reviewed separately.

Eligibility rules
  • It depends on the employer type, how many people work at your Maine site, and how long you have been there.
  • Private employers need at least 15 employees at one Maine location. Municipal employers need at least 25. The State is included, but the separate under-15 permanent-worksite exclusion can still apply.
  • A permanent worksite with fewer than 15 employees is excluded.
  • Ordinary eligibility needs 12 consecutive months with the employer. School administrative unit employees have a separate 900-hour route in the preceding 12 months under the statute’s specified federal-leave terms.
What you get
  • Up to 10 work weeks of job-protected leave in any two years.
What the help includes
  • This leave protects eligible employment but does not itself replace wages. Maine PFML may provide pay and its own protection.

  • Your employer checks the leave request against the law. Eligible Maine paid leave runs at the same time, rather than adding a second block afterward.
Good to know

The private-employer size test counts one Maine location. A company-wide headcount alone does not answer it.

  • Give 30 days’ notice unless it is an emergency. Maine-only leave does not make the employer keep paying its share of your health insurance; federal FMLA and Maine PFML do.

The trap: The size test looks at one location in Maine, not the whole company. A national chain with 4,000 staff but 11 in your town does not cross the private-employer floor. Ask the employer for the headcount at your worksite in writing.
