Federal family leave and your employer’s own policy can protect time away for your child’s care.

A covered employer does not automatically make every worker eligible for FMLA. Your service, hours and worksite size also matter. Some Mississippi public employers offer paid or donated leave for family illness.

Eligibility rules
  • FMLA generally requires 12 months of service, 1,250 hours worked in the preceding year, and 50 employees within 75 miles.
  • Private employers generally need 50 employees for 20 workweeks. Public agencies and public or private elementary and secondary schools are covered regardless of size.
What you get
  • Up to 12 weeks of unpaid, job-protected FMLA leave for eligible workers.
  • Continued group health coverage under FMLA’s rules.
  • Possible employer paid or donated leave when the employer’s policy permits it.
What this includes
  • Some public-employer policies allow accrued major medical leave or donated leave for a child’s serious illness. One university’s policy is not a statewide entitlement.
  • Mississippi has no statewide paid family-leave benefit or paid-sick-leave entitlement for private-sector workers. FMLA may protect unpaid leave when its employer and employee tests are met. Covered state employees have separate paid parental leave for birth or adoption, accrued major-medical leave that may cover a child’s illness, and possible donated catastrophic leave. Those public-employment rules are not a paid cancer-care benefit for every parent; HR can check the employee’s coverage, available balance and overlap with FMLA.

  • Your answers here do not settle your employer’s legal type, worksite headcount or hours worked. HR’s policy and work history are needed.
  • The state employee handbook effective July 1, 2026 gives qualifying permanent full-time employees with 12 consecutive months up to six weeks or 240 hours at full salary for birth or adoption, generally within 12 weeks of that event. This is not a general paid cancer-care benefit. Accrued major-medical and donated leave have separate family-illness rules.

How to apply

First step: Write to HR asking which leave applies to you, and keep the reply.

  1. Ask HR, in writing, for the leave policy and whether the federal law covers you.
  2. If you work for a school district, a county, a city or a university, say so: those employers are covered whatever their size.
  3. Ask specifically whether any paid leave, including donated leave, can be used for a child's illness.
