What it is
The New Jersey Family Leave Act can protect your job while you care for your child.
State family leave has its own employer-size and work-history tests. Those tests changed in July 2026. NJFLA has a separate eligibility test from the protection attached to family-leave pay.
Eligibility rules
- Since July 17, 2026, the private-employer threshold is 15 employees. Public employers have no size floor.
- The work-history test is three months with the employer and 250 base hours in the preceding 12 months.
What you get
- Up to 12 weeks of job-protected leave within 24 months.
- Coverage at private employers with at least 15 employees, and public employers of any size.
What the help covers
- The state entitlement is measured over 24 months rather than the federal FMLA's 12-month period.
- State and federal leave usually run at the same time for the same absence, and Family Leave Insurance can pay during it. Leave taken earlier for your own illness does not use up state family-care leave. You can take it in separate days with 15 days' notice, less in an emergency.

The trap: The pay and the job protection are separate tests. A parent can be entitled to state family-leave pay and still need this law, or the newer protection that comes with the pay, to keep the job.
