New Mexico’s child care assistance can pay for care for other children while your family manages treatment.
New Mexico opened child-care assistance without an income ceiling in November 2025. Work, study and other qualifying situations or exemptions still matter. ECECD confirms current funding conditions, copayments and places.
Eligibility rules
- New Mexico residency is required. The no-income-ceiling category began November 1, 2025, with funding and other eligibility rules still applying.
- Each resident parent or legal guardian must meet a qualifying activity or status, or an approved exception. The rules include work, education and training, but also specified situations such as job seeking, homelessness and agency-approved exemptions. Family leave and some other temporary activity changes can preserve an existing child-care arrangement.
- ECECD checks identity, New Mexico residence, age, legal authority where needed, qualifying activity and an eligible care setting. Treatment-related leave can fit temporary-change rules but does not automatically establish the parent-incapacity exception.
- The September 9, 2026 rule ordinarily covers children from six weeks to before age 13. An approval before 13 can continue for its 12-month period. Specified special-needs or court-supervision provisions cover ages 13–19.
What you get
- Help paying for eligible child care, with any copayment confirmed by ECECD.
- Continued eligibility through a qualifying temporary change in activity.
What this includes
- There is no income limit. If funding runs short, families above 600% of poverty can be asked for a copayment with 90 days' notice, and a waiting list is possible; ask ECECD whether either is in force now.
- During an eligible temporary activity change, the child may continue attending care.
If you decide to apply
- Ask the social worker about the Early Childhood Education and Care Department’s child care application.
- Have the sibling’s care needs and your current work or other activity ready to discuss, including treatment-related changes.

After you apply
- Approval names the child care setting and copayment.
- An approved case usually has at least 12 months of eligibility. Initial job seeking and presumptive approval have shorter periods. Limited family or sick leave, seasonal or school breaks, and reduced hours can preserve care. Stopping work or education for less than three months can also be temporary. A longer change may end the paid placement while the eligibility period stays open. ECECD confirms the placement and payment dates.
- You have 14 days to send the documents, or 30 if you ask for more time.
Good to know
Your child's illness is not the same as the parent-incapacity exception. If no parent is working or studying, ask ECECD before you rely on it.

- The no-income-cap category opened in November 2025. Income alone does not replace the remaining eligibility tests.

- No income limit is not no conditions: the rule still asks that a parent be working, studying or training.
