West Virginia’s Parental Leave Act gives eligible public employees unpaid leave to care for a seriously ill child.

West Virginia’s Parental Leave Act gives eligible public employees unpaid leave to care for a seriously ill child.
Some public employees have a state leave right as well as federal FMLA. This state leave protects the job but is unpaid. Annual and personal leave must be used first.
Eligibility rules
- Covered employers are units of state government and county boards of education, not private employers.
- The employee must be permanent and have at least twelve consecutive weeks of service. Annual and personal leave must be exhausted first.
What you get
- Up to twelve weeks of unpaid protected leave in a twelve-month period.
- Restoration to the position held before leave.
- For state employees, use of up to 80 hours of accrued sick leave annually for family care.
What the protection covers
- The 80-hour family sick-leave provision uses leave already accrued by a state employee. It does not create a general paid family leave program.
If you decide to apply
- Ask your human resources office to check the state Parental Leave Act and FMLA together.
- Ask the care team for a letter confirming the serious health condition.
- For planned treatment, give the employer two weeks’ written notice and ask which leave must be used first.

- Human resources reviews employment history, the request and medical documentation, then identifies the applicable leave.
Good to know
The state personnel policy runs state leave and FMLA at the same time. It does not promise two separate twelve-week blocks.
Other details
- State leave and federal FMLA run at the same time, not one after the other. During FMLA you keep paying your usual share of the health premium; during leave protected only by the state law you pay the whole premium, so ask HR which applies to each week.

Ask whether the refusal is about the employer being covered or about your length of service.

- It covers public employers only, not private ones.
- It starts after annual and personal leave are exhausted.
- The state's policy says the two leaves are used up at the same time, not one after the other.
