A pending approval can delay treatment. The state clock starts with a complete electronic request. The clinic’s medical explanation is what supports using the urgent deadline.

Eligibility rules
  • The five-day and two-day clocks start when the plan has a complete request sent electronically. Public-employee (PEIA) and individual policies follow matching rules; a private employer that pays claims itself is usually outside them.
  • The cited group-policy rules apply to policy years beginning January 1, 2024 or later. Private self-funded ERISA plans are not automatically subject to these state insured-plan deadlines. The Insurance Commissioner and plan administrator confirm individual-policy, PEIA, other public-plan and church-plan rules separately.
What you get
  • A five-business-day deadline for a standard complete electronic request.
  • A two-business-day deadline when the request is urgent.
What the protection covers
  • Some doctors with a high approval record are exempt from asking permission for certain procedures; the clinic can say whether that applies to your child's doctor. It never covers prescription drugs.
  • The exemption does not cover pharmaceuticals, experimental treatment, noncovered benefits or out-of-network services.
If you decide to apply
  1. Ask the clinic for the date the complete electronic request reached the plan.
  2. Ask the treating doctor whether the medical situation supports marking the request urgent.
  3. Ask the plan to confirm the decision deadline in writing.

  • The insurer or PEIA answers the clinic’s request. An incomplete request does not start the same clock as a complete electronic one.
Good to know

An exemption from some procedure approvals does not itself exempt prescription drugs. Your clinic can check which drug approvals this plan requires.

Watch out

  • The clock runs from a complete electronic request, so ask the clinic to confirm both.
  • A gold-carded doctor still needs authorisation for drugs, so chemotherapy is not exempt.
  • If the employer plan is self-funded, the state clock does not bind it; ask the benefits office which kind it is.

The trap: A gold-carded doctor can skip authorisation for some procedures, but the law says in terms that pharmaceuticals are still authorisable, so chemotherapy drugs keep needing approval.
