What it is
West Virginia lets a prescriber seek an exception when a plan requires a different drug first.
A plan may ask for a different medicine before paying for the one your doctor chose. The prescriber can explain which legal exception fits. The rule also requires a drug for the condition while the request is decided.
Eligibility rules
- The law covers health benefit plans with prescription benefits using step therapy, issued, delivered or renewed in West Virginia from January 1, 2018.
- The rule reaches the pharmacy benefit manager on most plans, including some self-funded ones; ask the plan which exception process it follows for your prescription.
What you get
- A route to bypass a fail-first drug requirement.
- A drug for the condition while the exception request is pending.
What the protection covers
- An exception can apply when the required drug is contraindicated or would harm your child.
- Other grounds include expected ineffectiveness, failure of a drug in the same class, a drug against your child’s best interest, or stability on the chosen medicine.

- Ask the prescriber to identify the legal ground that fits your child’s treatment.
- Ask the clinic to submit that reason in writing and request a drug during the review.
- Ask the plan for its response deadline and keep the request date.

After you ask
- The plan must decide quickly but the law sets no fixed number of days. While it decides, it must cover a medicine for the condition, though not necessarily the one requested; the oncologist can say why waiting is dangerous.
Good to know
The request needs the specific medical reason for an exception. A general letter about the diagnosis may leave out what the plan needs.

- Ask the plan to supply a drug for the condition while the request is decided.
- Ask the plan in writing what its own deadline is, since the statute gives none.

Expect friction on: The statute says the override shall be granted expeditiously and gives no number of hours
The trap: The plan has to provide a drug for the condition at least until it decides. Ask for that in the same call, so your child is not left with nothing while the paperwork moves.
