Unemployment after a work loss
WorkForce West Virginia provides unemployment benefits after qualifying work losses. Quitting for family care has a specific disqualification.
What it is
WorkForce West Virginia provides unemployment benefits after qualifying work losses. Quitting for family care has a specific disqualification.
Unemployment is money for people who lost their job through no fault of their own. If your employer lets you go or cuts your hours, you can claim. If you quit to care for your child, West Virginia does not pay until you have worked at least 30 more days in a covered job. Each week you claim you also have to be able to take a full-time job, which is hard during intensive treatment.
Eligibility rules
- If your employer cuts your full-time hours, part of a week can be paid. Earnings above $60 come off the weekly amount, rounded down. Hours you cut yourself for caregiving do not open a claim.
- A layoff does not carry the specific family-duty quit disqualification.
- Each week you have to be able to take a full-time job, report what you earned, and show four job-search steps unless WorkForce excuses you. A Low Earnings Report from your employer can change the job-search rule. Caring for your child does not excuse the rules on its own.
What you get
- $24 to $662 a week, depending on past wages.
- A maximum benefit balance of 26 times the weekly benefit rate.
What the protection covers
- Benefits run from $24 to $662 a week, depending on past wages, for up to 26 weeks' worth.
- A partial-unemployment balance can last beyond 26 calendar weeks because the limit is a multiple of the weekly rate.
If you decide to apply
- Ask the employer’s human resources office about available leave before deciding whether to resign.
- If considering a claim, explain the work loss or hours change to WorkForce West Virginia through its online application route.
- Have the employer’s written account of the separation or reduced hours ready.

After you ask
- WorkForce West Virginia decides whether the work loss and other eligibility conditions qualify.
Good to know
This mainly helps a parent whose employer ends or cuts the job. Leave keeps the job; quitting to care for your child bars a claim until you have worked 30 more days.
Other details
- A leave agreement and a resignation have different consequences for the job and health plan as well as unemployment.

- Official reference for unemployment
“If my work changes because of my child's treatment, would unemployment pay me, or does quitting rule it out? Does this fit us, and can you help me look at leave first?”
Why I’m asking: I do not want to mistake unemployment for paid caregiving leave and lose income or coverage.

Who does what
The three parts, side by side. The agency decides; nobody on this page does.
You
Ask for leave in writing before resigning, and keep the employer's answer.
Your social worker
The employer can offer unpaid leave instead of accepting a resignation.
The care team
A letter about the treatment schedule helps the leave request.
- Who decides
- WorkForce West Virginia.
- Ask HR
- “My child is in treatment and I need time away. Before I resign, can we agree leave, paid or unpaid, in writing?”
How to apply
First step: Ask the employer in writing for leave before you resign, and keep the reply.
- Before resigning, ask the employer for leave, even unpaid leave, in writing.
- If a parent has been laid off, apply: a layoff is not the disqualifying kind of separation.
- If you have already left, apply anyway and let the agency decide.

Where it starts: Apply online with WorkForce West Virginia if work has ended.
What to gather
- Your written leave request
- The employer's answer
- Any layoff notice
How long: Apply as soon as work ends; the agency says to apply even when you are unsure.
What a yes looks like
A weekly benefit amount and a maximum balance of 26 times it.
What a no looks like, and the next move
If the no is about the reason you left, ask whether the separation was recorded as a layoff or a quit, and appeal.
Watch out
- Resigning to care for your child is a disqualification written into the statute.
- Cutting your own hours does not open partial benefits; those are for an employer-driven cut.
- A layoff is different, and does not carry the disqualification.
Dates that change this
2025-07-01: The published rate table effective July 1, 2025 lists $24–$662 weekly. WorkForce confirms the table and balance applicable to the claim.
The numbers and the rules

What it is worth
The July 1, 2025 table lists $24–$662 a week and a maximum balance of 26 times the weekly rate. WorkForce confirms the claim’s rate and separate eligibility tests.
- $662/week — Maximum weekly benefit on July 1, 2025 table
- $24/week — Minimum weekly benefit on the posted table
- $26 — Maximum benefit as a multiple of the weekly rate
- $30 — Covered work needed to requalify after a family-duty quit
Legal protection: A layoff is not a family-duty quit, and does not carry the disqualification
What it costs the family: Nothing to apply.
The eligibility facts, as published
- Disqualification
- quitting to perform a marital, parental or family duty, until returning to covered employment for at least 30 working days
- Duration
- a maximum benefit of 26 times the weekly rate, with a partial-unemployment balance able to run past 26 weeks
- Partial
- An employer-driven reduction in full-time hours can support a partial claim, subject to weekly eligibility. Gross weekly earnings above $60 reduce the weekly benefit, rounded down to a whole dollar.
Decisions this site cannot make: WorkForce West Virginia monetary and separation determination
Expect friction on: Partial benefits are for an employer-driven cut in hours, not one a parent chooses
The trap: Cutting your own hours does not open partial benefits either. The poster describes partial unemployment as an employer-driven reduction, for a business slowdown or a breakdown.
